Former President Trump Requests Supreme Court Approval for State Guard Troop Deployment in Chicago Area

Judicial Challenge Over Military Presence

In an immediate request, the US Department of Justice pressed the judiciary to overturn a earlier court order that had halted the sending of hundreds of military reserve personnel to the Chicago region.

The federal judge had voiced concerns about the administration's justification for sending troops, doubting its reasoning in considering regional circumstances.

A federal appeals court upheld the lower court’s decision on the previous day, keeping the deployment on pause while the judicial dispute continues.

Government's Claims

The top government lawyer, speaking on behalf of the administration, claimed in the latest petition that government officers have often been “menaced and targeted” in the city of Chicago and the neighboring town of Broadview area.

This area is home to an Immigration and Customs Enforcement holding center.

The former president has earlier sent state guard units to Chicago, Illinois and the city of Portland, following previous deployments to LA, Memphis, Tennessee, and the nation's capital.

The president has claimed that troop deployment is needed to reduce protests and bolster deportation efforts.

Political Opposition

Opposition leaders have vehemently criticized the action, claiming that the White House's statements are overstated and driven by politics.

They accuse the president of misusing his executive power to target political rivals.

The judiciary have also expressed doubt about the government's portrayal of the situation.

Local leaders say that rallies over ICE activities have been mostly small and non-violent, contrasting with the former president's portrayal of “war zone” situations.

Legal Basis

At the heart of the conflict is the president’s use of a US code permitting the commander-in-chief to take control of the national guard only in situations of insurrection or when “unable with the regular forces to execute the laws of the United States”.

The government insists that the troops are required to defend government buildings and officers from activists.

Recent Events

Earlier this month, the administration took control of 300 troops of the Illinois national guard and directed more Texas national guard forces into the Illinois.

As state authorities denounced the move, the president escalated his rhetoric, urging the arrest of Chicago’s mayor and the Illinois governor, both Democrats, alleging them of failing to safeguard ICE personnel.

Illinois and the city of Chicago filed a combined lawsuit the administration to halt the activation.

On 9 October, the presiding federal judge, a Biden appointee, handed down a temporary injunction blocking the command.

Simultaneously in Chicago, at least a dozen people were taken into custody outside the Broadview Ice detention center following heated confrontations between state law enforcement and activists.
